Conservative backbenchers lead by Bernard Jenkin are proposing to introduce a rule in the AV referendum bill to ensure that the result will only be binding if 40% of all registered voters (i.e. including non-voters) support the change. This would mean that opponents of reform could win by default if not enough participate in the referendum. We don’t require this rule for elections, so why apply it to referendums? 615 out of 650 MPs have the support of less than 40% of all registered voters – two-thirds of MPs don’t even have the support of 50% of the people who do vote in their constituency.
